Frequently Asked Questions

I do not have any product/machine to show at the time of audit. How can the audit take place?

A product is usually required for the BIS audit. If unavailable, you may need to reschedule or provide valid documentation. In some cases, old working machinery can be shown as a reference.

If we make different models of the same machine, should they be mentioned in one application or separate applications?

Separate application for each product and ISS is required to be submitted even for same factory location. Separate application for each factory location is required to be submitted, even if the product and ISS is same.

How is testing performed for different models of a machine with the same IS number?

Testing is done as per the requirements of the specific IS (Indian Standard) number. If multiple models fall under the same IS standard, BIS may select representative models for testing based on design variations and critical parameters. In some cases, all models may need testing if they have significant differences. The final testing requirements are determined by BIS based on product specifications.

Do we need BIS if we import a machine and sell it in India?

Yes, if the machine is listed under mandatory BIS certification, it must comply with BIS standards before being sold in India. Importers can apply for certification, but the manufacturer must meet BIS requirements. For foreign manufacturers, certification is granted under the Foreign Manufacturer Certification Scheme (FMCS). if applicable. If you import parts and manufacture some components locally, you may need both FMCS for imported parts and a separate BIS certification for the locally manufactured components.

Do I need BIS if I already have a CE certificate for importing machinery and selling in India?

Yes, BIS certification is required if the machine falls under the mandatory BIS list, regardless of CE certification. CE is a European standard, whereas BIS is specific to India, and both operate independently.

If I take a franchise of an existing BIS-certified product, do I still need BIS certification?

No, if the product is already BIS-certified under the original manufacturer’s name and you are only selling it without modifying or rebranding, separate BIS certification is not required. However, if you manufacture, rebrand, or make any modifications, you may need a new BIS certification.

Does the assembly of machinery fall under BIS certification?

Yes, if the machinery falls under the OTR (Order of the Technical Regulations) and is listed under mandatory BIS certification, assembly must also comply with BIS standards. In such cases, both the assembled machine and critical components may require certification.

How can I get BIS if I do third-party manufacturing?

If you outsource manufacturing to a third party, BIS certification must be obtained in the name of the actual manufacturer. You can apply as a trademark owner under the Indian Standards (IS) Mark Scheme or Compulsory Registration Scheme (CRS), ensuring the third-party manufacturer is BIS-certified. A legal agreement between you and the manufacturer may also be required.

If my product is not covered under the mentioned HSN code, do I still need BIS?

BIS certification is based on product standards, not HSN codes. Even if your product is not listed under a specific HSN code, it may still require BIS certification if it falls under the mandatory BIS list. It is best to verify for compliance requirements.

Will an audit be conducted during BIS certification renewal?

No, a renewal audit is not required unless there is a substantial technological change in the product that demands reassessment. Regular renewals typically do not involve an audit.
